In California, there are 2 types of child custody: physical and legal.
Physical custody refers to where the child will reside, and it can be
joint (time is split fairly evenly between each parent), or sole and primary
(the child lives with one parent while the other parent may only visit).
Legal custody can also be joint or sole, and allows the parents to make
decisions regarding the child’s education, religious training, healthcare,
extracurricular activities, and other factors.
Child custody orders in California are based on the child’s best
interests. Courts will consider:
- The age and sex of the child
- The emotional relationship of the child with both parents
- The child’s ties to community and school
- The health of the child
- The ability of each parent to care for the child
- Any history of domestic violence or substance abuse
The parent who spends less time with the child will be able to seek visitation
rights (also known as “time-share”). This may involve a visitation
schedule ordered by the court, reasonable visitation that is determined
by both parents, or supervised visitation, if deemed necessary. However,
if visitation will threaten the physical or emotional health of the child,
it will be denied.
